Wyoming Signs “Heartbeat” Abortion Ban, But Governor Warns It May Not Survive Court Challenge

Wyoming’s long-running abortion debate just entered another chapter.

On Monday, Mark Gordon, the governor of Wyoming, signed House Bill 126 into law, a measure that bans most abortions once a fetal heartbeat can be detected.

That milestone typically occurs around six weeks into pregnancy, often before many women realize they are pregnant.

But even as he signed the bill, Gordon issued a warning: The law will likely end up back in court, potentially continuing a legal tug-of-war that has already stretched across several years in the state.

What the New Law Does

Under the newly signed law:

  • Abortions are prohibited once a fetal heartbeat is detected.
  • Medical providers must check for a heartbeat before performing an abortion.
  • Performing or attempting an abortion after a heartbeat is detected could lead to:
    • Felony charges
    • Loss of medical license

The law includes an exception for medical emergencies involving the mother.

However, it does not include exceptions for pregnancies resulting from rape or incest, a provision that Governor Gordon specifically raised concerns about in his signing statement.


The legislation arrives just months after the Wyoming Supreme Court struck down two abortion bans passed in 2023, ruling that the Wyoming Constitution protects residents’ right to make their own health care decisions.

That constitutional protection stems from a 2012 amendment originally designed as a response to the Affordable Care Act, which lawmakers at the time feared could limit individual health care choices.

Because of that ruling, Gordon suggested the new law may be vulnerable to the same legal arguments.

“This Act represents another well-intentioned but likely fragile legal effort,” Gordon wrote in a letter to House leadership.
“I fear we have only added another chapter to the sad saga of repeatedly trying to force a specific solution.”


What Happens If Courts Strike It Down

The bill anticipates the possibility of legal challenges.

If courts invalidate the heartbeat ban, the law contains a fallback mechanism:

State leaders, including the Attorney General, Secretary of State, and the Legislature, would certify the ruling. If that occurs, Wyoming law would revert to a “viability” standard.

Viability generally refers to the point when a fetus can survive outside the womb, which typically occurs around 23–24 weeks of pregnancy.


Strong Support in the Legislature

Despite the governor’s concerns about its durability, the bill passed with overwhelming support in the Legislature.

Final votes were:

  • House: 51–7
  • Senate: 27–4

The measure was sponsored by Chip Neiman, a Republican lawmaker from Hulett, Wyoming.

Supporters argue the bill protects unborn life, while opponents say it conflicts with constitutional protections recognized by the state’s highest court.


The Larger Constitutional Fight

Earlier this year, lawmakers attempted to send a constitutional amendment to voters that would have clarified abortion policy in Wyoming.

That proposal failed during the legislative session, leaving the courts as the likely battleground once again.

Governor Gordon suggested a more durable solution may require either a constitutional amendment approved by voters or a narrowly crafted law designed to comply with the Wyoming Supreme Court’s interpretation of health care rights.

What Happens Next

For now, the heartbeat law takes effect immediately.

But given Wyoming’s recent legal history, few observers expect the issue to stay settled for long.

If legal challenges arrive, and many expect they will, the debate over abortion in Wyoming will once again move from the Legislature to the courtroom.

And as the governor himself acknowledged, the Equality State may be headed for yet another round of pro-life litigation before any long-term policy is settled.
